Temporary Skilled Shortage (TSS) Subclass 482 Visa

Short-term stream (STSOL) – Medium-term stream – Labour agreement stream

The following is a brief summary of the new requirements pertaining to the TSS subclass 482 visa. The eligible occupations lists have been refurbished  and some occupations have been moved to the regional areas.

The new streams for the new work visa TSS subclass 482 will derive from the skilled occupation lists, the Short-Term List (STSOL), the Long-Term List (MLTSSL), the Regional Occupation List (ROL) and in some circumstances via a Labour Agreement.

Short-term stream (STSOL)

This visa enables employers to address labour shortages by bringing in skilled workers where employers can’t source an appropriately skilled Australian worker.

Any TSS subclass 482 visa-based occupation from the short-term list, will be for the maximum duration of two years (up to 4 years if an International Trade Obligation (ITO) applies and Hong Kong passport holders may stay up to 5 years). You can also now apply for two extensions onshore.

Medium-term stream (MLTSSL)

This visa enables employers to address labour shortages by bringing in skilled workers where employers can’t source an appropriately skilled Australian worker.

​​​​​​​​​​​​​​​​​​​​​​​​​​​​​​​Your occupation is on either the Medium and Long-term Strategic Skills List (MLTSSL) or the Regional Occupation List (ROL) and you can work in Australia for up to four years.

A visa applicant subject to short-term list occupation will be required to satisfy the GTE (Genuine Temporary Entrant) criteria for the grant of a 3rd TSS subclass 482 visa.

Labour agreement stream

This visa is for skilled workers nominated by employers who have a Labour Agreement. It lets you live and work in Australia temporarily. Labour agreements are developed between the Australian Government (represented by the Department) and employers.

Some Recent Great News regarding these Visas

From 25 November 2023 the Employer Nomination Scheme (subclass 186) Temporary Residence Transition Stream regulations will change.

Changes planned for TRT stream nomination requirements include;

  • allowing employers to nominate holders of all streams of TSS visas (including Short-term and Labour Agreement streams).
  • removing the requirement for nominated occupations for the TRT stream to be assessed against a skilled migration occupation list. The nominated occupation will need to be listed in the Australian and New Zealand Standard Classification of Occupations (ANZSCO) and the nominated worker will need to continue to work in the occupation nominated for their TSS visa(s).
  • reducing the period of time a TSS visa holder must hold their visa and work in their nominated position or occupation to be eligible to be nominated by their employer for the TRT stream to two out of the three years before nomination (previously 3 out of 4)
