Employer Nominated Subclass 186 Visa

Direct-Entry Permanent Skilled Worker

  • This is a permanent residence visa for skilled workers who have a nominating employer.
  • A visa application in this category allows Australian employers to nominate skilled foreign employees to work in Australia on a permanent basis.
  • This is a two-step process;
    Stage 1. Is the nomination application by an approved Australian employer and;
    Stage 2. Is the visa application by the skilled overseas worker.
  • Importantly, as long as the applicant has a valid visa, they can be in Australia when they apply for this visa.

Stage 1: Nomination Application

The application by the employer relates to the skilled position that you have been offered. This position must be for at least 2 years and the ‘Annual Market Salary Rate (AMSR) for the position must be paid, and this rate must be above $70,000 per annum.

The employer must also pay a once-of ‘Skilling Australians Fund (SAF)’ levy of $3000 if their annual turnover is below $10 million or $5000 if their turnover is above $10 million (other visa conditions will also apply).

Stage 2: Visa Application

This must be made within 6 months of the nomination application being approved OR it can be lodged at the same time the nomination application is lodged, but it will not be processed until after the nomination application is approved.

You must also fulfil the Skilled requirements, for the grant of this visa, including the standard Health and Character checks (contact us if you require advice). You may be in Australia or outside Australia when you apply for this visa and when it is granted.

Skills Assessment Application

A critical part of your application is that Skilled Migrants must provide an approved skills assessment (from an Australian Skills Assessment Authority) before they can apply. Their skills and experience must be assessed as to be equal to those of an Australian skilled person performing the same work in the nominated occupation.

Recognition of your skills is a critical part of an application in this category. If you do not have a formal qualification and your skills where obtained ‘on-the-job’, you can still apply for recognition of those skills via ‘Recognised Prior Learning (RPL) This is a critical process which we are very familiar with, so please contact us for expert guidance.
