PERMANENT RESIDENCY FOR SC482 SKILLED WORKERS

The Australian Government’s changes for Temporary Residence Transition Stream (TSS) nomination requirements include:

  • allowing employers to nominate holders of all streams of TSS visas (including Short-term and Labour Agreement streams) and
  • reducing the period of time a TSS visa holder must hold their visa and work in their nominated position or occupation to be eligible to be nominated by their employer for the TRT stream to two out of the three years before nomination and
  • updating age exemptions for regional medical practitioner applicants and high income earning applicants aged 45 years and over to allow for a two-year pathway.

PATHWAY TO PERMANENT RESIDENCE FOR ELIGIBLE REGIONAL VISA HOLDERS

If you hold a;

  • Skilled Work Regional (Provisional) (subclass 491) visa or a
  • Skilled Employer Sponsored Regional (Provisional) (subclass 494) visa.

You can transition to a Permanent Residence (Skilled Regional) visa (subclass 191) permanent residence visa in Australia (if you meet the eligible requirements attached to your 491 or 494 visa) and there is no minimum income requirement to do so.

Primary applicants must provide notices of assessment issued by the Australian Taxation Office (ATO) for the previous three income years out of the five years of their eligible visa.

WORKING HOLIDAY MAKERS – 6-MONTH WORK LIMITATION

In 2022, the Department of Immigration temporarily relaxed the work limitation for a WHV holder. This meant they were given an exemption from the need to work for any one employer for 6 months.

2024 Update

The Department of Immigration made the decision to continue this exemption while consultation on the Working Holiday program settings and reform process is underway and revamped.

This exemption applies to anyone in Australia who holds:

  • ​any kind of WHM visa, regardless of when they arrive, or holds
  • a Bridging visa with condition 8547 imposed.

PRIORITISING STUDENT VISA APPLICATIONS.

The integrity of the international Student Visa Program in the education sector has been strengthened via a new evidence level framework to prioritise applications from International Students wishing to study in Australia provides the highest priority to;

  1. Student visa applications lodged outside Australia

  2. Certain higher Education, English Language Intensive Course for Overseas Students (ELICOS) and Vocational Education and Training (VET) studying at an ‘high-end’ education providers.
  3. Subsequent entrant applications lodged outside Australia that include an unmarried family member under 18 years​ (a subsequent entrant means an additional applicant who did not apply at the same time as the primary applicant.
  4. all Student Guardian visa applications (lodged in or outside Australia).

Also, any secondary applicant (spouse, de-facto partner or dependent child) who is included in the primary visa application will be given the same priority as the primary applicant.
