SKILLED WORK REGIONAL VISA (SUBCLASS 491)

To be eligible and approved for this visa you must either be nominated by a state or territory government or sponsored by an eligible family relative living in a Regional area of Australia. This visa is granted for 5 years, and you can become eligible to be granted permanent residency after 3 years.

You must also;

  • Have a relevant occupation on the skilled occupation list
  • declare that you have a suitable skills assessment for your nominated occupation (that was obtained in the 3 years before your applied) at time of invitation.
  • only apply for this visa if the Australian Government invites you to.
  • (as this is a ‘points-based’ granted visa) obtain a score of at least 65 points to be invited to apply for this visa (but depending on the competitiveness for the grant of a particular visa you may need to score higher than 65 points).   • be aged under 45 years to be invited to apply. Please note however if you turn 45 after you apply for this visa you will still be eligible to apply for permanent residency.

If you are sponsored by an eligible relative, you (or your spouse) must be related to them in the following way:

  • Non-dependent child – including a natural, adoptive or step-child;
  • Parent – including adoptive or step-parent;
  • Brother or sister – including adoptive or step-siblings;
  • Niece or nephew – including adoptive or step-niece or nephew; or
  • Aunt or uncle – including adoptive or step-aunt or uncle;
  • Grandparent or first cousin.

Note:
This visa is ‘Points Tested’ and a positive ‘Skills Assessment’ is also required which is usually based on the applicant’s formal qualification and their work experience. However, in some circumstances where the applicant has only work experience, they may be eligible to be assessed via the ‘Recognised Prior Learning’ process. Also, please note that some nominated positions require certain work experience or specialised skills.

TRAINING VISA

This visa allows you to take part in workplace-based occupational training activities to improve your skills for your job, area of tertiary study, field of expertise or in a professional development training program in Australia.

With this visa you can

  • visit Australia to complete a workplace-based  training (to improve your skills for your current occupation, area of tertiary study or field of expertise), or a professional development training program

You must

  • be sponsored and
  • be nominated

Nomination Types

There are 3 types of occupational training covered by this visa:

  • Occupational training required for registration
  • Occupational training to improve skills in an eligible occupation
  • Occupational training for capacity building overseas. This includes overseas qualification, government support or professional.

Occupational Training is the most popular

This is designed to improve skills in an eligible occupation.
It is  a workplace-based structured training program that:

  • is specifically tailored and timed to the training needs of the nominee.
  • is in relation to an occupation specified on the list of eligible skilled occupations.
  • involves a nominee who has recent and suitable prior experience. This can include employment experience or study experience that:
    • is the equivalent of at least 12 months full-time experience in the occupation in the 24 months immediately before the nomination is lodged

STUDY ENGINEERING – MIGRATE TO AUSTRALIA?

VISA CANCELLATIONS- REFUSALS

Both Permanent or Temporary visas may be cancelled by the Department of Home Affairs if you do not pass the “Character Test” but the good news is these can be appealed to the Administrative Appeals Trubunal (AAT) (successfully in most cases).

You will not pass the character test if you:

  1. have a “substantial criminal record” which is defined as you;
    • were sentenced to a period of imprisonment of 12 months or more or
    • have an association with an individual, group or organisation which is suspected of being involved in criminal conduct; or
    • are not of good character having regard to your past and present criminal or general conduct; or
    • are at significant risk of engaging in future, unacceptable conduct.

When an appeal is made to the Administrative Appeals Tribunal (AAT), it must be done within a strict timeframe.

BUSINESS INNOVATORS – OWNERS – INVESTORS

This category of visa is for people who want to own and manage a New or Existing Business or Invest in Australia. It is a temporary 5-year visa (that can also be extended for 2 years) and once the applicant is established, they can apply for permanent residency.  Even a Franchisee can be acceptable in this visa category in certain circumstances.

This visa is ‘Points’ based’, and applicants can either be in Australia or overseas to lodge this visa. However, if you apply as a ‘Significant Investor’, Premium Investor or for an extension of the temporary visa,  the points test will not apply.

Points are awarded for:

  • age
  • English language ability
  • qualifications
  • experience in business or investment
  • net personal and business assets
  • business turnover

SKILLED NOMINATED SUBCLASS 190 VISA

This visa is for Highly Skilled Workers and Professionals who are nominated to live and work permanently in Australia. An application in this category has a few requirements such as;

  • You must obtain a ‘Positive Skills Assessment’ and
  • You must lodge an ‘Expression of Interest’.

A State or Territory government may then invite you to apply for this visa.

SKILLED REGIONAL SUBCLASS 491

The definition of Regional Australia has changed. All parts of Australia except the cities of Sydney, Melbourne and Brisbane are now regarded as Regional

EMPLOYER NOMINATION SCHEME (ENS) SUBCLASS 186 VISA

Current SC482 Visa holders will now be able to transition to permanent residency (PR) via the ENS SC 186 Visa providing that;
• Their occupation exists on the relevant ‘Skilled Occupation List’
• The occupation they nominate for PR is related to their current Nominated Occupation.
• They have held a SC 482 (or 457) Visa for at least 2 years
• They have worked with their current employer for at least 2 out of the last 3 years on a full-time basis, while located in Australia.

STATE AND TERRITORY NOMINATED SKILLED VISA

The subclass 190 visa is similar to the subclass 189 visa as its also ‘Points Tested’. However, highly skilled workers or professionals who do not meet the pass mark for the 189 visa can be granted an additional 5 points if an Australian State or Territory Government nominates them.

These applicants can also work and live permanently in Australia and must obtain a skills assessment in their nominated occupation too. Also, please note that each State or Territory government has their own set of requirements that all applicants who want to be nominated must meet.
